The DeKalb County Board of Commissioners last week deferred a resolution supporting legal action against the city of Dunwoody for the eighth time in eight months.
However, District 1 Commissioner Elaine Boyer said she welcomed the deferral.
“I feel this is a positive step,” she said of the ongoing negotiations. “We have asked to continue mediation with the city of Dunwoody.”
The suit, which was proposed by District 5 Commissioner Lee May in September last year, challenges the city’s incorporation of the DeKalb Perimeter Community Improvement District without a countywide referendum.
The fledgling city is currently negotiating with the county for the transfer of county-owned property, including the multi-million-dollar Brook Run Park facility on North Peachtree Road.
The board also deferred District 6 Commissioner Kathie Gannon’s proposed alcohol ordinance update.
The proposed ordinance will allow restaurants in mixed-use developments to serve alcohol despite their proximity to schools or churches.
The current alcohol code prohibits the sale of beer and wine within 100 yards of schools and prohibits the sale of liquor within 200 yards of schools and churches.
A mixed-use development is a special zoning classification that allows residential, commercial and retail space on the same property.
“We are trying to put together a live/work/play atmosphere,” Ms. Gannon said at the May 19 board of commissioners meeting. “We are finding it hard for restaurants to serve alcohol on premise.”
The board is scheduled to address both measures again next month.
