City council votes against Walmart; NPU-B feels relief

One day after the Atlanta City Council voted to “file,” or dismiss without action, Fuqua Development CEO Jeff Fuqua’s proposed mixed-use project in Buckhead, the city’s Neighborhood Planning Unit B discussed the resolved issue.

Both of Fuqua’s land-use and zoning change requests, denied 11-2 and 10-2, would have included a Walmart on Lindbergh Drive.

But Atlanta residents fought back and got their way, requesting the council to comply with the city’s law, SPI-15, which preserves the proposed area for residential and pedestrian-friendly use.

“We never vote to deny something unless we have a legal basis in which to stand on,” NPU-B chair Sally Silver said Tuesday at its monthly meeting at Cathedral of St. Philip in Buckhead. “This is the first time ever for other NPUs to stand up and lock arms with us. … It’s about all of us, and everything we believe in and care about this city.”

The file period lasts for the next 24 months as stated in the city’s zoning ordinance, said Jessica Lavandier, principal planner for the city’s Bureau of Planning.

In other news, Maj. Van Hobbs, commander of the Atlanta Police Department’s Zone 2 in Buckhead, reported seven arrests of people breaking into cars in the last few weeks.

“It’s very few people committing a lot of crimes,” Hobbs said. “We’re putting all the right people in jail.”

Tiffany Harlow, Fulton County assistant district attorney, said there is possible gang-related crime cropping up in the Lindbergh area of Zone 2.

“We’re monitoring right now until we can confirm they are actually a gang,” she said.

Regarding the Randolph-Lucas House at 2494 Peachtree Road, it is on the Oct. 10 Urban Design Commission agenda for a demolition permit. Silver said it does not mean it is going to be “demo’ed” because the same permit is required to move a building, too.

“The condo association [2500 Peachtree Condominium Association Inc.] has no intention at this time to demo the building,” Silver said. “I believe they are very earnest in wanting to work this out.”

She said there are “ongoing negotiations” and “three possible announcements” regarding new ownership and re-location of the historic house.

Additionally, Silver said she is moving to a District 7 representative spot and will resign as NPU-B chair by Dec. 31.

The board voted unanimously to approve current public safety chair Bob Stasiowski as the new NPU chair.

There will also be a re-election of NPU business representatives Nov. 15 at 3109 Piedmont Estate and Gardens from 5:30 to 7:30 p.m.

There are three new candidates: Cathy Boston of Harry Norman, Realtors; Amy Hillman of Tatum Hillman Hickerson & Powell LLP and Brian Ward of Niles Bolton Architects.
